Terms of Use

1. Introduction

These Terms of Use ("Terms") govern your use of the NailGuard mobile application ("App", "we", "us"). By downloading, creating an account, or using the App, you agree to these Terms.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use NailGuard on your personal Apple-branded devices, solely for personal and non-commercial use in accordance with these Terms.

3. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or guardian.

4. Account Registration

You can register using your email and password, or through Google or Apple ID login. You are responsible for keeping your login credentials secure. Please contact bitingnail0@gmail.com if you suspect unauthorized access.

5. Subscriptions and Payments

NailGuard requires a paid subscription to access its features. All payments and renewals are processed securely through Apple App Store. We offer a 3-day free trial for new users to try the app before committing to a subscription.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription anytime in your App Store account settings.

If you purchase a subscription before the end of a free trial, any unused portion of the trial period will be forfeited.

We use RevenueCat to manage subscriptions securely and synchronize their status across devices. RevenueCat does not store or access your personal billing information.

5.1 Cancellation and Refunds

All subscription payments are final and non-refundable, except as required by applicable law. You may cancel your subscription at any time, but you will retain access until the end of the current billing cycle. No prorated refunds will be provided for unused portions of the subscription period.

By subscribing, you expressly consent to immediate access to the App and acknowledge that any right of withdrawal does not apply as the digital content is provided instantly upon purchase.

Refunds are handled directly by Apple, in accordance with their policies.

5.2 Chargebacks and Payment Disputes

In the event of a chargeback or payment dispute, your access to paid features may be suspended until the dispute is resolved. We reserve the right to terminate your account if fraudulent chargebacks are detected.

6. User Content

You may upload photos and related content to track your progress. You retain ownership of all photos. You grant us a limited, non-exclusive license to store and display them within the App. We do not share or distribute your photos to third parties.

7. Acceptable Use

You agree not to upload illegal, offensive, or infringing content; attempt to reverse-engineer or interfere with the App; use bots or scripts; or use the App for commercial purposes without written consent. Violation may lead to account suspension.

8. Privacy

Use of the App is subject to our Privacy Policy, which explains how we handle your data. By using the App, you agree to that policy.

9. Termination

You can delete your account at any time within the App or by contacting bitingnail0@gmail.com. We may suspend or terminate accounts for Terms violations or misuse.

10. Disclaimers and No Warranty

NailGuard is provided "as is" and "as available" without warranties of any kind. It is not a medical product or therapy. We make no guarantee that it will produce specific results or outcomes.

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

11. Limitation of Liability

The Application is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties and liabilities, including but not limited to:

• Errors or interruptions in the Application
• Loss of data or unauthorized access to user accounts
• Any issues arising from third-party services we rely on

To the fullest extent permitted by law, NailGuard Team's total liability shall not exceed the total amount paid by you for the service in the last 12 months.

In no event shall NailGuard Team be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

12. Changes to Terms

We may update these Terms periodically. Continued use of the App after updates means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of Poland and applicable EU regulations. Disputes will be resolved by the competent courts in Poland.
